Madison – Governor Walker signed 2017 Wisconsin Act 312 allowing any user of Milwaukee Metropolitan Sewerage District’s (MMSD) services to register a complaint with the Wisconsin Public Service Commission (PSC) and receive an impartial review. The bill also states that MMSD may not disconnect any government entity from the MMSD sewerage system without review and approval from the PSC.
Previous state statutes specified charges established by MMSD must be presumed reasonable in any review of the charges by the PSC. MMSD has not been treated like other utilities when it comes to settling disputes through the Public Service Commission.
MMSD is a regional governmental agency providing wastewater treatment and flood management services for 28 municipalities. MMSD serves all communities located within Milwaukee County except South Milwaukee. The district also serves several communities in Ozaukee, Racine, Washington and Waukesha Counties.
Representatives Mike Kuglitsch, R-New Berlin, Joe Sanfelippo, R-New Berlin, and Senator David Craig, R-Town of Vernon, released the following statements supporting changes to the MMSD Complaint Process:
“This new law will better balance consumer protections and ensure the PSC has a right-sized role in regulating MMSD. This is an important reform for member communities and consumers alike,” said Sen. Craig.
“The burden of proof that the District was at fault was exceptionally high, and this legislation balances the playing field so the average joe can stand up against what he feels is unjust and have a shot at winning,” stated Rep. Mike Kuglitsch.
“The signing of this bill means residents now may receive a fair hearing with the PSC when questions are raised about how MMSD sets rates,” said Rep. Joe Sanfelippo.
